Terms and Conditions
Descriptions:
All descriptions of activities supplied are indicative only. Moorland Adventure Sport reserves the right to alter the activity supplied, although it is accepted that the activity must remain within the same context i.e. 4x4 driving etc..
Supplier's Terms of Business:
Some of the activities provided by Moorland Adventure Sport are contracted to various independent suppliers and the terms and conditions of such independent businesses apply to Moorland Adventure Sport customers.
Prices & Payment:
On-line booking requires the full amount of the activity to be paid at the time of booking. Bookings made via the telephone, at the Langdale Quest site or at our Booking Centre in Pickering can be made with a 50% deposit paid at the time of booking, under these circumstances the balance of the invoice MUST be paid 14 days BEFORE the activity date. In either case all VOUCHERS must be paid for in FULL at the time of purchase.
Customer Cancellation & Refunds:
At the time of making a booking customers will be asked the quantity of vehicles & types they require us to reserve to meet their booking requirements. A reduction in these numbers can ONLY be made upto 14 days BEFORE the activity date if a reduction in the invoice amount is required. Any reductions made within 14 days of the activity date will not reduce the invoice total - i.e. NO refunds will be given if the booking has been paid for in full OR if a balance is still payable then the FULL balance will still be due for payment.
Delivery:
Moorland Adventure Sport will endeavor to dispatch all correspondence including booking conformations & vouchers etc.. within 48 hours of purchase & will normally use Royal Mail 2nd Class for delivery.
Should a voucher be required urgently it is recommended that the purchaser notifies Moorland Adventure Sport of this requirement as we can send vouchers Royal Mail SPECIAL DELIVERY at an additional cost to the purchaser - this should ensure receipt within 48 hours of purchase (weekends excluded).
Moorland Adventure Sport cannot be held responsible for any failure on the part of the Royal Mail, i.e. Moorland Adventure Sport are only responsible for such delivery up until the time the consignment enters the postal system.
Customer Bookings:
All open dated vouchers are subject to availability. Voucher recipients are asked to provide as much notice as possible when booking. Many peak dates, particularly at week-ends are very popular and may not be available unless a substantial period of notice is given. In any event bookings should be made a minimum of 14 days in advance. Do not make any travel or accommodation arrangements until your booking has been confirmed in writing.
Activity date change:
It is understood that on some occasions customers need to re-schedule their booked activity. Provided the date change is made 14 days or more BEFORE the current activity date an administration fee of £10 is payable & is subject to availability.
If the request for an activity date change is made within 14 days of the current activity date then a charge equal to 50% of the original booking invoice will be payable.
Voucher Exchanges:
Vouchers are non-transferable but may be exchanged once only for a different activity within the Moorland Adventure Sport range. An administration fee of £10 is payable plus any additional activity cost.
Credits:
If the Experience booked or exchanged is of a lower value than the voucher to be redeemed then the balance remaining will be held on the account of the original purchaser for a maximum of twelve months. After six months all credits will be forfeited.
Security:
All vouchers must be returned to us before exchange vouchers can be sent. Moorland Adventure Sport cannot be held liable for any missing or lost vouchers and all vouchers must be produced at the start of the activity booked. Moorland Adventure Sport reserves the right to ask for any evidence it may reasonably require to authenticate the identity of the customer or participant.
Expiry:
All vouchers are valid for a minimum of six months (unless stated otherwise) from the date of issue.
Extension of voucher Expiry date:
Unlike most companies offering a 'Gift Voucher' scheme, Moorland Adventure Sport does allow the extension of such vouchers. The following criteria MUST be followed however:
- Voucher MUST be extended from the date of EXPIRY - if done after expiry date then it will be back-dated.
- An administration fee must be paid at the time the voucher is extended - £7 for 6 months or £13 for a year.
- If the cost of the activity has increased since the date the voucher was purchased then the difference in cost between the old & new prices must also be paid.
Activity start locations:
Moorland Adventure Sport operates the largest off-road driving facility in the UK, covering over 40,000 acres. As a result the start point for each of its activities varies. For example the Langdale Quest 4x4 activity starts from the Langdale Quest car park. Our Quad Trail activities start from 2 different locations depending whether you are booked on our small family (no car license required) site or on our large Adult only Quad Trail (car license required) site.
Please ensure you are fully aware of the correct driving directions to the start point of your chosen activity.
Agreed activity start time - if YOU arrive late:
Please be aware that the time which is set as your activity start time IS the start time allocated for your booking! If you are running late for an activity we request that you call the booking office on 01723 882335 & advise us of your situation. Whilst Moorland Adventure Sport will make every effort to accommodate your booking it must be agreed that under some circumstances the vehicles / instructors will only be available for the balance of your booking time. Please remember that we do have other bookings & other customers & Moorland Adventure Sport cannot be held responsible for you arriving late for an activity.
It is advised that all customers allow at least 40 minutes travel time from either Pickering or Scarborough in addition to the rest of their journey time. As we operate in a National Park we are not permitted to display signs showing the way to our venue. As a result it is important that customers fully read & understand the driving directions given at the time of booking.
Moorland Adventure Sport reserves the right to charge a 'standby' fee for groups who are more than 15 minutes late for an activity. The charge for this is calculated in what we believe to be a fair way for both parties:
(Total activity invoice total / Activity duration in minutes) x number of minutes on 'standby' / 2
For example: this group was 25 minutes late for their activity - Start time 10am - they arrived 10.25am
Invoice total £300 / Activity duration 180 minutes x 25 minutes on standby / 2 = £20.83
This charge is to cover instructor wages, however, NO charge is payable if the original END time for the activity remains the same - i.e. only the remaining time set for the activity is used & no extension in activity time is provided - the choice is yours!
The option of extending the END time of the activity to allow for a LATE start is obviously subject to availability on the day of your booking - we may have other bookings which require the use of the same vehicles / instructors. Under these circumstances we would NOT be in a position to extend the END time of the activity and Moorland Adventure Sport does not accept any responsibility in loss of activity time because of this - if the customer(s) had arrived on time then the activity would have been provided in full.
In the event of a group booking when some of the group has arrived on time & some of the group are still to arrive Moorland Adventure Sport staff will notify those who are present that it will be their responsibility to advise us when they wish to begin their activity. They will be given the responsibility of deciding when to 'give up' waiting for the rest of the group in exchange for beginning their activity. If and when the balance of the group arrives Moorland Adventure Sport will do their best to accommodate such persons within the activity, however, on some occasions this will not be possible for logistical reasons. Again Moorland Adventure Sport will not accept any reasonability for customers arriving late for an activity nor will we accept any responsibility for the effects this has on your booking - NO refunds will therefore be issued as a result of some group members been unable to participate due to arriving late.
Agreed activity start time - if WE run late:
Occasionally, due to a previous activity running over-time we are unable to start your booking at the agreed time On these rare occasions Moorland Adventure Sport will ensure that the full activity duration is provided - running into darkness is not usually a problem for us! It is advised therefore that customers should allow a little 'run on' time. Therefore please do not make other reservations immediately after your activity with us, allow at least 1 hour + travel time to your next port of call. Moorland Adventure Sport does not accept responsibility for activities running 'over-time' - please allow for this.
Problems and Complaints:
Any problems or complaints must be made direct to Moorland Adventure Sport either during or at the end of your activity on the day of the Experience in order that the issue may be promptly addressed by Moorland Adventure Sport staff.
Availability:
All Moorland Adventure Sport activities are subject to availability, on the rare occasion that an activity needs to be cancelled due to a vehicle breakdown or staff injury Moorland Adventure Sport will allow the activity to be re-booked for an alternative date at no charge to the customer. Moorland Adventure Sport will endeavor to notify the customer as soon as the problem arises but accepts no responsibility in travel or accommodation expenses incurred.
Drivers ages and licenses etc...
Some of the activities provided by Moorland Adventure Sport require the drivers to be over the age of 18 & have held a full car license for a minimum of 12 months. Please ensure you have checked this BEFORE making a booking. Also, it is the responsibility of the person making the booking to ensure that all participants within their group meet the required driver criteria.
Moorland Adventure Sport's right to terminate an activity:
Moorland Adventure Sport will not permit any vehicle to be driven or occupied by any person, whose conduct is not in keeping with the peaceful environment of the forest. As a result we reserve the right to terminate any activity should the need arise.
